The competition is not affiliated in any way to Instagram and is in no way sponsored, supported or organized by Instagram. The contact and responsible party is SCHUNK SE & Co. KG, with its registered office at Bahnhofstraße 106-134, 74348 Lauffen/Neckar, Germany (hereinafter referred to as the "Organizer" or together with all affiliated companies of the SCHUNK Group as "SCHUNK").
Residents of Germany who are at least 18 years old are eligible to participate. An Instagram account is required to participate. SCHUNK employees and their relatives are excluded from participation. Participation through electronic registration systems, so-called collective service providers and so-called disposable email (also known as "trash mail") will not be considered.
A person enters the competition by leaving a comment under our 1,000 Follower Special reel, dated October 18, 2023, on how many people can be seen in this reel. The other conditions of participation must still be fulfilled. Multiple participation is prohibited.
The entry deadline for the competition is December 15, 2023 at 12:00:00 pm German time. Receipt of the corresponding comment, which is recorded electronically, is used for verification purposes and to ensure compliance with the deadline.
In order to conduct the competition, certain information is required from the participant (e.g. name, date of birth, address, email address and any other information required for participation in the competition, e.g. answers to the competition questions). The collection of personal data is for the purpose of organizing the competition, unless the participant has granted SCHUNK consent to the further processing of their data (e.g. for the purpose of registering a user account). The legal basis for the processing of data is the fulfillment of the contractual obligation arising from participation in the competition (Art. 6(1)(1)(b) GDPR).
The data of the winner will be processed by SCHUNK for the purpose of processing the prize and, if necessary, will be transmitted to a shipping service provider. This data is not otherwise disclosed to third parties. We store the personal data of the winner as long as it is necessary for a particular processing purpose. We store the personal data of other participants who have not given their consent to the further processing of their data for a period of 90 days after the end of the competition. This does not apply to comments made on the respective post as part of the competition. These comments will remain permanently visible after the end of the competition, unless the participant requests their deletion. If the participant has given consent to the further processing of their data, we will store their data for the purposes stated in the consent until the consent is withdrawn. This consent can be withdrawn at any time with effect for the future. After expiry of the aforementioned periods or after withdrawal of consent, the data will be deleted unless the storage of this data is required for longer due to statutory retention periods. Unless otherwise specified in the competition information, the winners will be selected at random by SCHUNK from all participants whose answers are correct or complete according to the relevant specifications. The chance of winning for an individual participant therefore largely depends on the total number of participants in the competition.
The competition information provides more details about the relevant prize, including any possible restrictions, cooperation services or costs that apply when claiming or for claiming the prize. The items presented as prizes in the competition may not necessarily be identical to the items won, and instead may differ in terms of model, color or other features.
The winners will be notified by SCHUNK through a direct message on Instagram. Notification will occur within four weeks of the entry deadline. In the event of an undeliverable prize notification, SCHUNK is not obliged to make any further inquiries. If the winner does not respond within four weeks of the notification being sent, claim to the prize will be forfeited. Claim to the prize will also be forfeited if the prize cannot be transmitted within two months of the first notification of the prize due to reasons attributable to the winner. In such cases, SCHUNK reserves the right to withhold the prize or to select another winner and notify them in the same way.
Prizes in kind will be sent by SCHUNK or the shipping service provider by email, forwarding agent, courier service or post to the address specified by the winner without shipping costs or similar.
The prize may not be exchanged for cash. The prize is not transferable.
By participating, the participant accepts the conditions of participation and declares that he/she has read the above data protection provisions.
If a photo is uploaded that depicts people, the participant warrants that he/she is authorized to upload the photo both with regard to the photo itself and with regard to all of the people depicted in the photo. The participant warrants that he/she is the author or producer of this image. In particular, the participant warrants that he/she will observe all relevant rights of use and ancillary copyrights as well as other rights to the image and that the image and the performance(s) are unencumbered by third-party claims. In addition, the participant warrants that he/she respects the rights of all people that can be seen or heard on the image, in particular the right to own image and other personal rights, and that all of these people have agreed to the upload and use of this image. This applies to all people who can be seen in the image, even if a person is only accidentally visible in the background of the image. In addition, the participant warrants that the image does not violate any applicable laws and does not give rise to any other complaints. In particular, he/she guarantees that the image does not contain any pornographic, racist, otherwise offensive or illegal content and does not infringe any copyrights or trademark rights. No clearly recognizable images of copyrighted works, trademarks or labels have been used in the participant's images. SCHUNK reserves the right to hide the visibility of entries.
Participation in the competition is free of charge, with the exception of the transmission costs incurred according to the tariff chosen by the participant's mobile phone or internet provider. There are no hidden fees.
SCHUNK accepts no liability for the loss of data, particularly in the course of data transmission, and other technical defects.
SCHUNK reserves the right to exclude participants from the competition due to the provision of false information, manipulation, or the use of unauthorized aids.
Legal recourse is excluded.
The law of the Federal Republic of Germany applies exclusively. Unless otherwise prescribed by law, the place of jurisdiction for all disputes arising directly or indirectly will be Heilbronn.
Should single clauses contained in this conditions of participation become invalid, the validity of the other terms remain unaffected.
These conditions of participation can be changed by SCHUNK at any time without separate notification.
